General provisions

These General Terms and Conditions of Sale are reserved exclusively for consumers, within the meaning given by law and jurisprudence, acting exclusively on their own behalf.

In accordance with Articles L. 111-1 and L. 111-3 of the Consumer Code, the essential characteristics and prices of the Goods and Services sold electronically are available on the Website.  www.lyonbiketour.com. These General Terms and Conditions of Sale apply to all sales of Goods and Services by SARL LYON ORIGINAL TOURS. These General Terms and Conditions of Sale apply to all CLIENTS who participate in the services sold by LYON BIKE TOUR, even if the CLIENT did not personally book the service. By participating in the service sold, the CLIENT is deemed to have accepted these general terms and conditions of sale. The specific conditions for the sale of each tour (price, itinerary, etc.) as well as the General Terms and Conditions of Sale shall be those in force on www.lyonbiketour.com at the date of booking confirmation. LYON BIKE TOUR reserves the right to modify all or part of these General Terms and Conditions of Sale at any time. The CUSTOMER declares that they have read these General Terms and Conditions of Sale prior to validating the booking. Validation of the booking therefore constitutes unreserved acceptance of these General Terms and Conditions of Sale.

ARTICLE 1: PURPOSE

1-1- These present terms constitute, to date, the General Terms and Conditions of Sale for the services marketed by LYON BIKE TOUR, namely the organization of guided Electric Assist Bicycle (EAB) tours along predefined routes, allowing for the discovery of the city of Lyon. The tours are conducted in French or English.

ARTICLE 2: RESERVATION

2.1 Availability

The booking of a service sold by LYON BIKE TOUR must be made at least 10 hours in advance and is subject to available stock.

2.2 Booking terms and conditions

The booking of a service marketed by LYON BIKE TOUR is made either by phone at +33 (0)6.51.36.33.47, by email at contact@lyonbiketour.com or directly online at www.lyonbiketour.com. In all the cases mentioned above, the order is considered confirmed only if the customer receives confirmation by email or SMS.

ARTICLE 3: PAYMENT

The CUSTOMER pays for their online order by credit card, cash, or bank transfer no later than the day of the service.

ARTICLE 4: CANCELLATION AND REFUND

4.1 Cancellation of the reservation by the client (individual)

If the CUSTOMER wishes to cancel their reservation, they must inform LYON BIKE TOUR at least 72 hours before the start of the ordered service, by email at the following address contact@lyonbiketour.com, by telephone at the following number: +33 (0)6.51.36.33.47 or by registered mail with acknowledgment of receipt to the following address: SARL Lyon ORIGINAL Tours, 25 rue Guilloud, 69003 Lyon France. In the event of cancellation by registered letter with acknowledgment of receipt, the date of receipt of the mail will be taken into account for the calculation of the aforementioned period. The refund will take place within thirty days of the cancellation by bank transfer. Any cancellation made less than 72 hours before the day and time of the booked service will not be accepted by LYON BIKE TOUR and will not give rise to any refund. Any partial or total interruption of one of the services by the CLIENT shall not give rise to any refund or compensation.

4.2 Cancellation for a private service (Groups & companies)

Full cancellation 30 days prior: no penalty. 30 days to 7 days prior: billed at 25%. 7 days to 3 days prior: 50%. Day 3 to the day of the event: billed at 100%

Partial cancellation 30 days before the event: no penalty. 30 to 3 days before the event: changes allowed up to 50%. Final headcount confirmation 3 days before the event

4.3. Cancellation of the service by LYON BIKE TOUR

LYON BIKE TOUR reserves the right to cancel the booked service if the number of participants is fewer than 4 people and if the safety or interest of the participants requires it. The decision to maintain or cancel the service rests with LYON BIKE TOUR. In the event of cancellation by LYON BIKE TOUR, the latter undertakes to refund the CLIENT the full amount paid by them. In the event of interruption of the service after it has begun, LYON BIKE TOUR undertakes to refund all or part of the amount paid, the amount of which will be assessed by it. The refund will be made within thirty days of the cancellation, by bank transfer.

ARTICLE 5: SERVICE

The content of the services is described on the website www.lyonbiketour.com LYON BIKE TOUR provides the CLIENT with an electric assist bicycle and its equipment in order to carry out a predefined tour with a guide.

5.1 The Electric Assisted Bicycle and its equipment

The provided Electric Assistance Bicycle (EAB) has sufficient battery range for the proposed route time and includes the following accessories: – a poncho in case of rain – a protective helmet, a hairnet, and a front basket. The bike can be equipped with a child seat upon request (+€5)

5.2 Access to benefits

Access to LYON BIKE TOUR services is open to minors aged 12 to 18 accompanied by an adult who meets the weight and height criteria below.

The bicycle can be used by a person measuring over 1m50 and weighing less than 120 kg.

5.3 Tour procedure

The meeting point is at the historic Lyon Palace of Justice located at 23 Quai Romain Rolland, 69005 Lyon at the indicated time. The guide will then pick up the customers taking the tour to take them to the bike room located in Parc Saint Jean (Lyon Parc Auto). The starting point of the tour is at the bike room provided by Lyon Parc Auto, Pont Maréchal Juin, 69005 Lyon.

The CLIENT must arrive at the meeting point at least 15 minutes before the tour's departure time. The times indicated on the booking confirmation must be strictly respected. Being more than 15 minutes late for the scheduled time will result in the cancellation of the tour, without giving rise to any refund or compensation.

5.4 The chaperone/Guide

Before departure, the tour leader explains the safety rules, distributes safety equipment, and explains how the Electric Assist Bicycle works. The tour leader alone decides the pace of the tour, the breaks, and the itinerary, which they adapt according to the participants' abilities. The tour leader/guide reserves the right to cancel the tour or modify the route if safety or the participants' best interests require it.

5.5 Client Participation Condition

The CLIENT agrees to use the bicycle in a reasonable and prudent manner. The CLIENT declares that they are able to ride an electric bicycle and have the physical condition suitable for such use. The CLIENT agrees to comply with the highway code and the safety instructions provided by LYON BIKE TOUR before departure. The CLIENT is not authorized to leave the group, except when exceptionally invited to do so by the tour leader/guide. The CLIENT is solely responsible for their actions on public roads. LYON BIKE TOUR cannot be held responsible for any accident occurring as a result of the CLIENT's or a third party's behavior. The CLIENT assumes custody of the electric bicycle and its equipment, which are placed under their responsibility.

5.6 Return of the bicycle

The CLIENT agrees to return the bicycle provided at the end of the tour. The bicycle must be returned to the pick-up point located in the bicycle storage room at Parc Saint Jean (Lyon Parc Auto), Quai Romain Rolland, 69005 Lyon

ARTICLE 6: LIABILITY – INSURANCE

LYON BIKE TOUR provides its customers with an electric bicycle in good working order, regularly serviced, and compliant with current regulations and safety requirements. LYON BIKE TOUR has third-party liability insurance. At the time of the tour, the guide provides safety instructions, which the CUSTOMER agrees to follow. Safety instructions are sent by email to each customer who has booked. The CLIENT is solely in control of the bicycle they are using. LYON BIKE TOUR cannot be held liable in the event of damage sustained by the CLIENT during the tour. The CLIENT is solely responsible for any damage they may cause to third parties or other participants during the tour. Parents or legal representatives of a minor participating in the tour shall be held responsible for any damage caused by the latter during the tour. The CLIENT is informed that they must have personally taken out third-party liability insurance, which covers them in particular for the use of bicycles, in order to guarantee coverage in the event of damage occurring during the tour. Failing to have taken out such insurance, they cannot hold Lyon BIKE Tour responsible for the absence of this personal coverage. All fines and tickets that may be incurred due to the use of the Electric-Assist Bicycle by the CLIENT shall be exclusively their responsibility.

ARTICLE 7: LOSS, THEFT AND DAMAGE

From the time they are made available and until their return by the CLIENT, the electric bicycle and its equipment are under the custody of the CLIENT. The CLIENT shall be solely responsible for any loss, theft, or damage to the bicycle and the equipment provided to them. In the event of loss, theft, or damage to the bicycle and its equipment, the CLIENT undertakes to compensate LYON BIKE TOUR by paying them an indemnity assessed at a maximum according to the

updated fee schedule and available at this address www.lyonbiketour.com and who is next: Following items broken, stolen or damaged:

Theft or total destruction: €2,000 – Frame scratches (€30) – Rims (€50) – Discs (€30) – Saddles (€40) – Luggage rack (€50) – Frame (€200) – Lock (€100) – Headlights (€40) – Pedal (€20) – Motor (€400) – Battery (€300) – Fork (€100) – Steering (€250) – Kickstand (€40)

The CLIENT declares having read this price list and agrees to pay the pre-established compensation upon first request by LYON BIKE TOUR. The CLIENT authorizes LYON BIKE TOUR in advance to request, on the day before the service, a direct debit authorization request for an amount of €2,000 on their bank account, it being specified that this amount will not be debited. In the event of any damage, the CLIENT authorizes LYON BIKE TOUR to cash the security deposit check.

ARTICLE 8 - AUTHORIZATION TO PUBLISH PHOTOGRAPHS

During the provision of the services, photographs of the CLIENTS may be taken. The CLIENT is informed and agrees that photographs in which they appear may be published by LYON BIKE TOUR on its website and on social networks such as Facebook, Instagram, Twitter, etc., for promotional purposes.

The CLIENT, not wishing for photographs in which they appear to be published by LYON BIKE TOUR on its website, must inform LYON BIKE TOUR before the start of the service or afterwards by sending an e-mail to the following address contact@lyonbiketour.com

ARTICLE 9 – DISPUTES, JURISDICTION AND APPLICABLE LAW

These presents are governed, interpreted, and applied in accordance with French law, with the French language being the language of interpretation in the event of a dispute regarding the meaning of a term or provision herein. In the event that they are translated into one or more languages, only the French text shall prevail in the event of a dispute. Subject to applicable mandatory provisions regarding jurisdictional competence, the courts of the registered office of LYON BIKE TOUR shall have sole jurisdiction to hear any dispute relating to the performance or interpretation hereof. The waiver by one of the parties of a clause of the Contract cannot be interpreted as a waiver of another clause of the Contract. The potential nullity of a clause of the Contract shall not entail the nullity of all or part of the Contract; such a clause shall be deemed unwritten. The headings preceding the articles of this Contract constitute indications only. In the event of difficulties of interpretation between one of these headings and a provision of this Contract, the headings shall be declared nonexistent.
